Terms and conditions
The terms set out in the booking form are the total agreement made between the parties and no variation or modification of this contract shall be effective unless agreed in writing by both parties.
Coverage: The client acknowledges and agrees that the scope and style of film coverage shall be determined by the professional judgment of MacDonald Studio. While client preferences and special requests are welcomed, they are not contractually binding; however, reasonable efforts will be made to accommodate them. In the absence of specific instructions, the client grants MacDonald Studio full artistic discretion in both filming and editing the event. Proof edits will be presented as condensed highlights of the day and may not include all footage captured. Any requests for extended or specific coverage must be clearly outlined in the “Special Requests” section of the booking form prior to the wedding date.
All images and footage are protected under the Copyright, Designs and Patents Act 1988. Copying, reproducing, or distributing any images/footage without written consent from MacDonald Studio is strictly prohibited and constitutes a breach of copyright.
Booking form: Agreements made prior to completing the booking form must be documented in the "special requests" section. Any amendments after the booking form's completion require a new booking form. The most recently completed form will serve as the final contract.
Digital Property: All digital files, including but not limited to original images, videos, edits, and master copies, remain the property of MacDonald Studio. Clients may purchase unedited digital files for £1000 up to 6 months after the wedding date. MacDonald Studio reserves the right to delete all original files, edits, online versions, and master copies one year after the wedding date.
Edits: MacDonald Studio retains full artistic license over all films. Highlights reels and cinematic edits are not subject to client revisions.
Extensive edits: Extensive edits requested after proof film delivery will be charged at £50 per hour, with a turnaround time of 4 to 6 weeks
Online property: Online highlights reels remain the property of MacDonald Studio and may be used for promotional purposes on social media or other platforms.
Sample films: Online sample films are for reference only and are not exact representations of the final edit. MacDonald Studio will endeavor to apply its signature shooting, editing, and color grading styles to each project.
Bridal/Groom Preparations
At the Wedding Venue: The videographer may leave the preparation area to capture other aspects of the pre-ceremony (e.g., guest arrivals, location shots). Full coverage of bridal preparations cannot be guaranteed unless explicitly requested and agreed upon in advance. Additional fees for a second videographer may apply.
At a Private Residence: Bridal preparations will be filmed for approximately 30–45 minutes.
Positions During the Ceremony
MacDonald Studio will make every effort to position cameras optimally for key moments (e.g., ceremony, speeches, dancing). However, the following factors may affect positioning and coverage:
Restrictions imposed by officiants (minister, celebrant, priest) on camera placement.
Guests or bridal party members moving into obstructive positions.
Venue layout, tall decorations, or other physical obstructions.
Readings: Efforts will be made to capture readings from the best possible angle, but front-facing coverage may not always be possible. If guaranteed coverage of readings is required, a second camera operator must be hired at the client's expense.
Arrivals: While MacDonald Studio will attempt to film the arrival of the bride, groom, and bridal party, this coverage is not guaranteed.
Camera operators: A single camera operator is included in all standard packages, operating up to three cameras. Static cameras may remain unadjusted during the ceremony due to venue restrictions. If dynamic coverage of static cameras is required, the client must cover the cost of a second camera operator.
Speeches:
Guest Reactions: While efforts are made to capture reactions during speeches, priority is given to filming the speakers.
Additional Speeches: Any additional speeches (e.g., blessings, grace) must be requested in the booking form. Impromptu speeches on the day may not be captured.
Force Majeure: MacDonald Studio is not liable for cancellations or alterations due to events beyond its control (e.g., natural disasters, illness). In such cases, liability is limited to a refund of all monies paid.
Cancellation fees:
Cancellation within 2 months of the wedding date: 50% of the package price.
Cancellation within 1 month: 100% of the package price.In absentia: In the event of any camera person being unable to perform or complete the agreement for any reason, including technical failure, ill health, accident, or vehicle breakdown, MacDonald Studio will use their best endeavors to secure a replacement. However, if no such replacement can be secured, then the liability of MacDonald Studio is limited to making a refund of all monies paid under the agreement.
Equipment: Whilst every effort is made to ensure that all equipment is in sound working order, MacDonald Studio’s liability in the event of the director or editor being unable to perform or complete the engagement due to malfunction of equipment shall be limited to making a refund of all monies paid under the agreement.
Camera shake: The client understands and accepts that camera shake sometimes can not be avoided when our tripods are set on wooden flooring or outdoors, although we will do our best to find a position that will reduce the probability of camera shake occurring.
Backup and Sound Quality
Backup Audio: In the event of primary audio equipment failure, onboard camera microphones will serve as a backup.
Sound Quality: MacDonald Studio is not liable for poor sound quality due to venue acoustics, PA systems, or interference from external factors.
Vows audio: The client understands and accepts that if a garment does not permit the wearing of a lapel mic then the audio from the celebrant’s lapel mic will be used as the primary audio source.
Formal photographs: The client understands and accepts that MacDonald Studio will cover short sections of the formal photographs while the photographer is taking them.
Wedding party: Whilst every effort is made to capture as many members of the wedding party as possible throughout the day, we can not guarantee every member of the wedding party will be captured.
Guests: Whilst every effort is made to capture as many guests as possible throughout the day, the client understands and accepts that due to the unpredictable nature of a live event, MacDonald Studio can not guarantee every guest will be captured.
Due balance: The balance of the package ordered must be paid in full 2 weeks before the date of the wedding, or MacDonald Studio reserves the right to cancel the booking/agreement.
Ceremony editing: The client understands and accepts that the wedding ceremony will be edited down to the key parts of the ceremony, which are: the bridal march, vows, readings, signing of the register (abridged), and exit. Priority filming will be given to these key parts. If the client requires prolonged capture of the ceremony this must be stated by the client in our booking form, in which case the client must list each part of the service they require filmed and for how long.
Music: The client understands and accepts that MacDonald Studio will make music choices for all films due to UK copyright and licensing laws.
Public holidays: The client understands and accepts that if a public holiday falls between their wedding date and the estimated turnaround date of their film, including any extras, there will be a delay in the estimated turnaround of the product.
Upgrading: Clients can upgrade their package at any point but cannot downgrade their package within one month of the date of the wedding.
Extra filming: All extra filming required after 9pm, or extra filming required over ten hours, will be subject to overnight accommodation charges and expenses.
Booking fee: The booking fee of £200 is non-refundable.
Discounts: Discounted wedding films are delivered as-is and are not eligible for client-requested edits or revisions.
Changing your date: If the client reschedules their wedding date within 6 months of the wedding date, and MacDonald Studio is available, an admin fee of £150 will be charged.
Second camera ops: Second camera operators are subject to availability. If available the second camera operator will cover the wedding from the vows to the speeches unless otherwise requested, in which case further fees will be incurred at the hourly rate of £50.
Associate filmmaker cover: The client understands that MacDonald Studio employs several camera operators and any one of them can be used to cover the client’s wedding. The client will be notified of this if an employed camera operator will be used.
Other filmmakers: No other filmmaker should be covering the same event (paid or unpaid). Friends and family are permitted to operate video cameras on the condition that they do not interfere with the professional coverage.
Guest conduct: The client is responsible for the conduct of their guests. The client will ensure that the guests at the event do not interfere with the filmmaker’s work. MacDonald Studio will not tolerate verbally or physically abusive behaviour. Unchecked guest conduct that interferes with filmmaking may seriously affect the quality of the film. If the client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the filmmaker, it will result in the early or immediate departure of the filmmaker. The client understands that in such an event, no refunds will be granted.
Drone use: Aerial filming is subject to permission from the landowner, safety assessments, weather conditions, and regulatory approval (CAA, ATC). Only qualified MacDonald Studio pilots may operate drones.
Additional entertainment: The client understands and accepts that if entertainment, additional to the wedding band (for example, singing waiters), has been booked, MacDonald Studio will cover two songs only.
Church ceremony: The client understands and accepts that the videographer will leave the church immediately after the ceremony ends to increase the chances of arriving at the wedding reception venue before the couple.
Film approval: The client acknowledges and agrees that if the Film Approval Form is not completed and returned within six (6) months of receiving the proof film, MacDonald Studio will consider the film approved by default. After this period, all associated raw footage may be permanently deleted at the sole discretion of MacDonald Studio.
Backup Responsibility: The client acknowledges and agrees that it is their sole responsibility to download and securely back up their final films from the Vimeo links provided by MacDonald Studio. MacDonald Studio is not liable for any loss of access to the links or the files once they have been delivered.
Additional Terms
Raw Footage: All raw footage will be deleted 4 weeks after the client approves their films.
Travel Expenses: Travel within 55 miles of Lanark is included. Travel beyond this distance will incur additional charges for fuel and accommodation.
Turnaround Time: Proof films will be delivered within 12–18 weeks, subject to seasonal demand. Minor revisions will take 3–6 weeks.
Complaints: Complaints must be raised in writing within 14 days of receiving the final package.
